In these Terms and Conditions, words or expressions beginning with a capital letter shall have the following meanings:
“Site”: The e-commerce website published by the Company and available at the following URL: bestonlineresume.com.
“User”: Any natural person of legal age as defined by the regulations applicable in their country of habitual residence, possessing full legal capacity or, failing that, duly authorized by a person with parental authority, a guardian, or a curator, acting for strictly personal purposes, and accessing the Site, whether as a simple visitor or a Client User
“Services”: All services offered on the Site and accessible to Users, as described in Article 3 of these Terms and Conditions and on the dedicated pages of the Site. Some Services are accessible free of charge and without a Subscription, including the trial of the CV Generator and the download of the CV in TXT format after this trial. Other Services, including advanced features (such as exports to PDF/DOCX formats, complete templates, AI-assisted cover letter creation, photo editing, and unlimited layouts), are only accessible to Client Users with a Subscription.
“Client” or “Customer User”: Any User of the Site who has subscribed to the Services offered by the Company by ordering a Subscription
“Customer Account” or “Account”: Any account opened by the User on the Site to subscribe to and access the Services offered by the Company as part of a Subscription
“Subscription”: A paid package granting access to Services reserved for Client Users. The Subscription is an open-ended contract, without commitment and cancellable at any time. It is automatically renewed monthly after a trial period, subject to payment of the Subscription price, in accordance with the Company's General Terms and Conditions.
“CV Generator”: An application module of the Site allowing the User to create one or more Curriculum Vitae (CVs) from the information they enter, where applicable with the help of Artificial Intelligence Systems integrated into the Services. The User can try the CV Generator for free, preview the generated content, and download their CV in TXT format without a Subscription, as this format allows for the retrieval of unformatted content. Access to the advanced features of the CV Generator (including presentation templates, layouts, exports in PDF/DOCX formats, and other associated Services) is reserved for Client Users with a Subscription.
“Artificial Intelligence System” or “AIS”: Any software system deployed by the Company within the framework of the Services (particularly within the CV Generator and cover letter creation tools), based on machine learning algorithms or models and designed to generate, autonomously or semi-autonomously, Results from the information entered or provided by the User
“Results”: Content, text, suggestions, formatting, or, more generally, any output generated by an Artificial Intelligence System within the framework of the Services, based on information entered or provided by the User, including, in particular, the content of CVs and cover letters.
The purpose of these Terms and Conditions is to define the conditions under which Users are authorized to access the Site and its Services, as well as the terms of use of its functionalities.
These Terms and Conditions apply to all Users, whether they are simply visitors or, a fortiori, beneficiaries of the Site's paid Services through the subscription of a Subscription.
If at any point during their browsing of the Site, the User wishes to benefit from the paid Services offered, they will then be invited to create a Customer Account and to accept the General Terms and Conditions of Sale of the Company available in the "GTC" section of the Site (hereinafter referred to as the "GTC"), prior to subscribing to any paid Subscription allowing access to the Services.
Prior and cumulative acceptance of these General Terms and Conditions of Use and the General Terms and Conditions of Sale is therefore necessary in order to access and benefit from all the Services offered on the Site.
Through the Site, Users can:
Familiarize yourself with the characteristics of the Services offered (as presented in Article 3.2 below, as well as on the dedicated pages of the Site), their price and their terms of availability,
Register on the Site and subscribe to the Services offered by the Company as part of a paid Subscription,
To pay for their subscription using secure payment services
To be informed of their rights arising from the applicable regulations, through these General Terms and Conditions of Use, but also of the General Terms and Conditions of Sale of the Company (available in the "General Terms and Conditions of Sale" section of the Site) whose acceptance is required prior to the validation of their possible subscription to a Subscription to the Services offered.
The Site offers Users, and in particular Customer Users with a Subscription, the possibility of accessing the following Services:
The Site provides a CV Generator allowing the User
to enter their information (civil status, education, professional experience, skills, etc.);
to benefit, where appropriate, from content suggestions generated by Artificial Intelligence Systems in order to structure and enrich their CV;
to preview how their CV will look with different templates and layouts offered by the Company.
The User can:
try the CV Generator for free and download the content of your CV in TXT format, without formatting and without subscribing;
If desired, subscribe to unlock all advanced features, including:
exporting your CV in PDF and DOCX formats with the selected layout templates;
modifying and updating their CVs within the interface;
CV duplication and unlimited exports.
Tools for creating cover letters
As part of a Subscription, the Client User benefits from online cover letter creation tools, integrated into the Site, allowing them in particular to:
to generate a cover letter consistent with the CV prepared via the CV Generator;
to rely on text suggestions proposed by Artificial Intelligence Systems;
to adapt the content and formatting according to the position sought and the sector concerned;
to upload their cover letter in the formats offered by the Company (including PDF and/or DOCX depending on the options available).
Photo retouching and visual integration services
As part of a Subscription, the Customer User can access photo editing and visual integration features, allowing them, depending on the options offered on the Site:
to upload a photograph to be included on his CV;
to benefit from tools for framing, optimizing or improving the photo in order to ensure a professional result;
to integrate this photo into compatible CV templates.
Unlimited templates, layouts, and exports
The Customer User with a Subscription benefits from:
access to a library of CV templates (classic, modern, original, etc.) and cover letters;
the ability to test and modify as many layouts as desired;
Unlimited generation and export of resumes in PDF and DOCX formats during the subscription period.
Editorial content, examples, and writing guides
Regardless of whether or not you subscribe, the Site also offers:
examples of resumes and cover letters by profession or sector;
writing guides, formatting tips, and editorial resources for job hunting;
various informative content designed to help Users optimize their applications.
This editorial content is accessible free of charge, subject to normal browsing on the Site, and does not in itself constitute a paid Service.
The Site and the Services offered by the Company are accessible to all Users, whether Clients or not, worldwide, without any deliberate geographical restrictions. Therefore, regardless of their country of origin, any User can freely browse the Site and access the content available there, provided they have the necessary technical means (Internet connection, compatible equipment, etc.).
In this context, the User may, in particular:
consult the presentation pages for Services, CV templates and editorial content;
access to guides, examples and advice published by the Society;
Try the CV Generator for free, by following the steps displayed on the Site (choosing a template, entering information, possible assistance from an Artificial Intelligence System, previewing the CV)
When using the CV Generator in test mode:
The User is asked to enter certain information, including a valid email address, which allows their CV creation session to be identified and may, if necessary, be used as an identifier for the subsequent creation of a Customer Account;
The User must read and accept these Terms and Conditions of Use as well as the Site's Privacy Policy prior to validating their test;
At the end of the test, the User can download the content of their CV in TXT format for free, without any Subscription or payment being required.
After this free trial, the User remains free to either limit themselves to downloading in TXT format, or to decide to subscribe to a Subscription to access all the Services and advanced features offered on the Site.
Access to paid Services (including exports in PDF/DOCX format, AI-assisted cover letters, photo editing and unlimited exports) is reserved for Users who have created a Customer Account and subscribed to a Subscription, under the conditions set out in these Terms of Use and the Company's Terms and Conditions of Sale.
To do this, the User must ensure that they have:
of an internet connection;
of a telephone subscription or network access allowing access to the Internet;
from a computer and/or a mobile device equipped with an adequate connection (such as Wi-Fi, 4G, 5G, etc.)
It is specified that any communication costs enabling access to the Site and its Services remain the sole responsibility of the User.
Subject to the foregoing, Users wishing to subscribe to a Subscription must follow the registration and Customer Account creation procedure described below, as displayed on the Site:
The User enters (or confirms, if already provided during the CV Generator test) a valid email address. This email address constitutes their identifier (Customer Username) and allows them to access their Customer Account and the Services to which they subscribe.
Depending on the Services offered, certain advanced features of the Site may require the User to provide additional personal data (for example, name, surname, or other relevant information), under the conditions specified in Article 8 "Protection of privacy and personal data — Cookies" of these Terms and Conditions.
Before being able to finalize the creation of their Customer Account and proceed with any Subscription order, the User must:
confirm that he has read and accepted these Terms and Conditions;
confirm that they have read the Privacy Policy applicable to the Website;
accept the Company's Terms and Conditions prior to subscribing to any Services.
These acceptances are confirmed by checking the boxes provided for this purpose on the Website, before clicking on the button to continue the registration or subscription process.
Once the required information has been entered and validated, and after accepting the Terms of Use, Privacy Policy, and Terms and Conditions of Sale, the User:
receives, at the email address used as login ID for his Customer Account, a secure login link (“magic link”) allowing him to access it; he can, if he wishes, define or change a personal password later from the “Settings” section of his Customer Account;
confirms their wish to subscribe to the selected Subscription, according to the terms and conditions displayed (trial period, monthly price, automatic renewal, etc.);
proceeds with payment of the Subscription via the secure payment methods offered on the Website.
At the end of this final stage:
the User's Customer Account is activated;
The Customer User may access all Services included in their Subscription for the entire duration of the Subscription.
A confirmation email is sent to the Customer User, summarizing the key details of their subscription, in accordance with the terms and conditions specified in the Company's Terms and Conditions of Sale.
A User may only hold one Customer Account linked to the same email address.
If all or part of the personal information requested proves to be incomplete or incorrect, the Company reserves the right to suspend and/or close the User's Customer Account and deny them access to all or part of the features of the Site and Services, without notice or compensation.
The User may, at any time, modify certain settings of their Customer Account (including their password) by accessing the “My Account” section of the Website.
Any use of a Customer Account remains the sole responsibility of the User who created it. The User remains responsible for the confidentiality of their username, password, and, more generally, any data they transmit to the Company. In the event of fraudulent use of their Customer Account, username, or password, the User agrees to immediately notify the Company.
If the User forgets or loses their password, or if they have not yet set one, the Customer User can log in to their Customer Account by requesting a secure login link ("magic link") to be sent to the email address associated with their Account. Once logged in, they can then set or change their password in the "Settings" section of their Customer Account.
The login details for the Customer Account, namely the email address associated with said Account, any passwords chosen by the Customer User, and the login links (“magic links”) sent to them, are strictly personal. The Customer User undertakes to keep this information confidential, not to disclose it to third parties, and not to transfer messages containing a login link to their Customer Account to third parties.
Once the steps for creating a Customer Account have been duly completed, the User may then, under the conditions set out in the Company's Terms and Conditions of Sale, take out a Subscription allowing access to the desired Services.
General obligations of Users — Users, whether Customers or simple visitors, undertake to access the Site and use its features in accordance with applicable laws and these Terms of Use.
The User is and remains, in all circumstances, in control of their use of the Site, its features, and the Services to which they have access. Consequently, the User must exercise discernment and caution with regard to the information they access and/or transmit when using the Site and the Services.
When using the features of the Site and Services, the User must always exercise restraint in their comments. They also undertake not to contravene any laws or regulations in force.
The User shall therefore refrain, in particular, from:
To misuse the purpose of the Site, its features, and Services for propaganda or proselytizing, solicitation, or prospecting.
To disseminate information contrary to public order and morality,
Publish information that violates personal data protection regulations allowing the identification of individuals without their consent, or collect and store personal data relating to other Users.
To transmit any message containing computer viruses or any other code, file, or program designed specifically to interrupt, destroy, or limit the functionality of software, computers, or any other telecommunications tools.
To communicate information linking to third-party sites whose content may violate any applicable law or regulation (in particular with regard to personal and property rights and/or intellectual property rights).
To disseminate content that infringes on the personal rights of third parties or that is abusive, defamatory, offensive, obscene, pornographic, violent, or incites discrimination, political violence, racism, xenophobia, sexism, or homophobia.
Harassing another User or Users in any way whatsoever,
Infringing on the intellectual property rights of third parties.
As such, the User i) indemnifies the Company against any claims, actions, and/or demands from third parties to which it may be subject and ii) undertakes to bear sole responsibility for all sums, damages, costs, attorneys' fees, and expenses to which the Company may be liable, without prejudice to compensation for the Company's own damages.
Furthermore, the User is solely responsible for any direct or indirect damage he/she may suffer as a result of inaccurate, incomplete, and/or misleading information provided during registration and/or failure to update such information, for which he/she alone shall bear the consequences.
If necessary, the Company reserves the right, without compensation and without prior notice, to suspend or close the User's Account and/or refuse them access to all or part of the features of the Site and Services in the event of use that does not comply with these Terms of Use.
Users remain responsible for their use of the Site and their actions, and must comply with these Terms by acting in a manner consistent with the Site's functionality and applicable laws and regulations. Any other use entitles the Company to take action under the conditions set out in Article 7 “Suspension — Termination” below.
The Company's Terms and Conditions (available in the “Terms and Conditions” section of the Website) may also contain specific obligations applicable only to Users who are Customers of the Services. These specific obligations are in addition to the present general obligations applicable to all Users, whether Customers or simple visitors to the Website and Services.
6.1 Technical Services — Connecting to the Site implies knowledge and acceptance by the User of the characteristics and limitations of the Internet and mobile phone networks, in particular concerning technical performance, response times for consulting, querying or transferring information, the risks of interruption, and more generally, the risks inherent in any connection and transmission over the Internet/mobile phone networks, the lack of protection of certain data against possible misappropriation and the risks of contamination by possible computer viruses circulating on the Internet and mobile phone networks.
Consequently, the Company shall under no circumstances be held liable, without this list being exhaustive
Any malfunction of the Internet and mobile phone networks preventing the proper running and/or functioning of the Services,
The transmission and/or reception of any data and/or information over the Internet or mobile phone networks,
Failure of any reception equipment or communication lines, loss of any data, or the consequences of any computer virus or bug, anomaly, technical failure,
Any technical, hardware, or software failure of any kind that damages a User's computer and/or mobile device.
It is the responsibility of each User to take all appropriate measures to protect their own data and/or software stored on their computer and/or mobile device against any infringement.
Finally, the Company cannot be held liable for any malfunctions of the Internet and mobile phone networks that may result in failures in the administration, security, integrity, or management of Customer Account data.
6.2 Accessibility and continuity of the Site — In principle, the Site is accessible 24 hours a day, 7 days a week, except in the event of an interruption, whether scheduled or unscheduled, in particular for maintenance purposes or in cases of force majeure.
However, the Company is only bound by an obligation of means in the continuity of the Site and the Services.
Consequently, the Company does not guarantee in any way that the site and the Services offered will be continuous, without temporary or permanent interruption, or without suspension or error.
Furthermore, any developments or changes to the Services may result in the Website being updated and/or temporarily unavailable, for which the Company shall not be held liable in any way.
Similarly, the Company reserves the right to interrupt or suspend one or more features of the Site at any time and without notice, without having to justify its decision. The Company shall not be held liable in any way for this, and Users shall not be entitled to claim any compensation of any kind in this regard.
The Company shall not be liable for any indirect damage or loss suffered by the User, or for any intangible damage such as loss of profits, loss of earnings, loss of use, loss or alteration of data, or costs incurred in acquiring substitute products or services, resulting from the use or operation of the Site and/or its Services, or from data accessible via the Site.
The Company shall not accept any claims relating to non-performance or poor performance of the Services that are attributable either to the User, to a third party not involved in the provision of the Services, or to a case of force majeure as defined in Article 15 below.
The Company may offer Users access to third-party websites (see Article 10 – “Links from/to the Website” below). In this case, the Company cannot be held liable for the activities of these third parties and urges its visitors to read the terms and conditions of use applicable to these third-party websites.
6.3 Company's responsibility as a host — the Company is not legally bound by any general obligation to monitor content transmitted or stored via the Site.
The only obligations inherent in the Company's status as a host concern i) the storage of Users' connection data, which is otherwise covered by professional secrecy and processed in accordance with the legal provisions on personal data, and ii) the removal of any manifestly illegal content, once the Company has become aware of it.
The Company undertakes to exercise all due diligence and care in providing high-quality Services.
However, the Company is only liable for an obligation of means, under which its Services will be performed in strict compliance with current professional standards and, where applicable, in accordance with the terms and conditions of the Customer User's order placed by the latter after having previously accepted the Company's GTC (available in the “GTC” section of the Website).
Given this obligation of means, the Company does not guarantee under any circumstances:
-- the suitability of the Services (and in particular the Results generated by the Artificial Intelligence Systems and the editorial content made available on the Site) to the User's specific needs, objectives, or constraints (in particular with regard to job searches, obtaining interviews, or selection for a position);
-- the total absence of errors, inaccuracies, or omissions in the Results, CV or cover letter templates, and, more generally, in any content accessible via the Site.
Consequently, the Company shall in no event be held liable for the absence of job offers, interviews, or recruitment, nor for any direct and/or indirect damage resulting from the User's use of the Results, templates, cover letters, or advice provided as part of the Services.
The User remains solely responsible for the final content of the documents they send to third parties (employers, recruiters, etc.).
Services incorporating features based on Artificial Intelligence Systems are provided to assist the User in creating resumes and cover letters. However, the Company does not guarantee the accuracy of the Results generated by these AIs. The User acknowledges that it is their responsibility to validate these Results before any use or implementation.
The results generated by Artificial Intelligence Systems do not constitute personalized professional advice and are used under the sole responsibility of the User.
The Company does not guarantee the completeness, accuracy, or suitability of the suggestions made by the Artificial Intelligence Systems for each individual situation. The User remains solely responsible for verifying, validating, and using the content provided.
The Results generated by the Artificial Intelligence Systems integrated into the Services, based on the information entered by the User, are and remain the exclusive property of the Company.
The Company guarantees that Artificial Intelligence Systems are developed according to reasonable standards and include measures to minimize algorithmic bias, without guaranteeing its total absence.
Finally, the Parties shall not be held liable in cases of force majeure or for other reasons beyond their control, such as work stoppages, strikes, disasters, or accidents (see Article 15 of these Terms of Use).
Users are responsible for their actions and conduct in the context of their use of the Site and its functionalities; they must therefore comply with the rules set out in these Terms and Conditions by acting in a manner compatible with the Site and applicable laws and regulations.
The Company is authorized to use all necessary measures to prevent or detect unlawful or fraudulent use of its Site and Services
In the event of non-compliance by the User with any of the provisions of these Terms and Conditions, the Company reserves the right, without prior notice or compensation, and taking into account the seriousness of the breach, to:
Inform the User of the said deficiency and ask them to remedy it;
Suspend the User's access to all or part of the Site, its features and Services;
As a last resort, and if the User fails to remedy the identified breach within a reasonable timeframe, terminate their access to the Site, its functionalities and the Services (while simultaneously deleting their Account and its content);
— And this is without prejudice to any other legal actions that may be available to the Company, as well as any damages to which the latter may be entitled.
In accordance with UK data protection legislation, in particular the UK General Data Protection Regulations (“UK GDPR”) and the Data Protection Act 2018 (“DPA 2018”), and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of personal data (“GDPR”), individuals who have logged into the Site and completed the registration questions in order to access the Site and its features are entitled at any time to:
Right of access: The User may, by proving their identity, obtain communication of data concerning them and check its accuracy;
Right to rectification: in case of inaccuracy of this information, he/she can demand that it be rectified, completed, updated, locked or erased;
A right to erasure (“right to be forgotten”): The User can obtain the erasure, as soon as possible, of data concerning him or her;
Right to restriction of processing: The User may, in certain cases provided for by the regulations, obtain the restriction of the processing of data concerning him/her;
A right to data portability: The User may, under the conditions set by the regulations, demand the transmission of data concerning him/her to another data controller, without the Company which initially collected it being able to oppose it;
Right to object: The User has the option to object to the processing of their data or to refuse the disclosure of information concerning them to third parties.
To exercise these rights, the User must contact Customer Service.
In any event, the User will ensure that they provide their name(s), surname(s), address and, where applicable, their Customer number.
The Company's strong commitment to respecting privacy and protecting the personal data of Users of its Site is demonstrated through the implementation of a Privacy Policy available in the "Privacy" section of the Site.
This Privacy Policy, an integral part of these Terms and Conditions, has been developed by the Company to ensure that all Users can browse the Site and use its features with complete confidence. Its purpose is to inform Users about the data that may be collected, how the Company may use it, and their rights regarding this data.
To offer personalized and enriched content that will improve the User experience, the Company may use small text files called "cookies" which may be stored on the User's terminal (computer, tablet, or smartphone) when browsing the Site with a browser.
Technically, during its validity period, a cookie allows its issuer to recognize the device in question each time that device accesses digital content containing cookies from the same issuer. Cookies issued by the Company or its partners are therefore used solely for the purposes outlined in its Cookie Policy, subject to the User's choices as determined by the settings of their browser software used when visiting the Website.
The Company owns all intellectual property rights (including copyrights) in the Site and the Services
These Terms and Conditions do not entail any transfer of intellectual property rights whatsoever to the User.
Thus, the Company is the exclusive owner of intellectual property rights, including those relating to:
The Site and its Services including its architecture, the structure and naming of its sections, its visual identity, its layout, its graphic charter, its design and its ergonomics;
the functionalities of the Site and its Services (including in particular the Artificial Intelligence Systems, the CV Generator and the photo editing and cover letter creation tools), as well as the texts, still or animated images, sounds, know-how, drawings, graphics and any other element constituting the Site and its Services;
the computer code (source code and object code) of the Site, the Services including in particular the Artificial Intelligence Systems, the CV Generator and the photo editing and cover letter creation tools, the software and APIs, the information, documentation, tutorials, forms, layout, graphic charter, photographs, video, soundtracks, CV templates, cover letter templates, guides, illustrations;
the databases, their organization and their content, created and administered by the Company in connection with the operation of the Site and its Services
all technical and graphic elements relating to the design of the Site and its Services;
the names, acronyms, logos, colours, graphics, or other signs that may be used, created or implemented by the Company on the Site or the Services.
The following are collectively referred to as the "Elements"
The Elements that appear or are available on the Site, or that constitute the Site and its Services, are thus protected under copyright, trademarks, patents, database producer rights or any other right recognized by applicable legislation.
Consequently, any copying, reproduction, representation, adaptation, alteration, modification, distribution, in whole or in part, of the Elements accessible via the Site and its Services and/or constituting the Site and its Services, whether it be Elements belonging to the Company, or to a third party, without prior authorization, is strictly prohibited (except for use or exploitation in accordance with these Terms and Conditions or the indications specified directly on the Site).
Upon accessing the Site and Services, the Company grants the User a private, non-exclusive, and non-collective right of use, excluding any commercial use. This grant is worldwide and for as long as the Site and its Services remain accessible. This right of use is non-transferable in any way.

Reproducing, modifying, altering, adapting, making available, translating, reverse engineering, decompiling or disassembling any part of the Site, or its Services (including, in particular, the Artificial Intelligence Systems, the CV Generator and the photo editing and cover letter creation tools);
Copying, modifying, altering, adapting or making available the computer code of the Site, or its Services (including in particular the Artificial Intelligence Systems, the CV Generator and the photo editing and cover letter creation tools);
And more generally, to copy, reproduce, represent, modify and/or exploit, in any way whatsoever and for any purpose whatsoever, all or part of the structure and Elements of the Site and its Services
The information and databases accessible on the Site and its Services are the property of the Company, with the exception of third-party content and third-party trademarks reproduced on the Site.
Therefore, unless expressly authorized in advance by the Company, any reproduction, representation and use is prohibited, including but not limited to:
Any adaptation, making available to the public on demand or otherwise, distribution, redistribution in any form whatsoever, networking, public communication of all or part of the Services, works, performances, trademarks and all elements protected or potentially protected by intellectual property law reproduced on the Site,
Any repeated and systematic extraction or reuse, including for private purposes, of even a non-substantial part of the content of the databases produced by the Company is prohibited.
Any User who does not comply with the terms of this article is liable to civil or criminal prosecution which punishes infringements of copyright, trademark and patent rights, database producer rights and automated data processing systems.
Without prejudice to the foregoing, the Company grants the User, for the Results generated via the Services and intended to appear on their own CV or cover letters, a private, personal and non-commercial right of use, allowing them to reproduce and communicate them to third parties in the context of their application process.
It is specified that this limitation to private, personal, and non-commercial use primarily concerns the reuse of models, layouts, templates, graphic or visual elements belonging to the Company and integrated into the Results. It does not restrict the User's ability to reuse, in any form and on any medium, the written content describing their own background, experiences, skills, or, more generally, personal information about them, including when they decide to reuse all or part of this content to integrate it into other documents (for example, another CV, an online profile, or a cover letter).
The User is the sole owner of the data constituting their own User Content used in connection with the use of the Site and its Services, or declares that they hold the rights and authorizations required to use such data.
The User grants the Company the right to reproduce, represent, adapt, translate, digitize, and use their User content solely for the purpose of providing the Services on any known or future communication medium in connection with the provision of said Services.
The User agrees that the Company may, in the context of providing the Services, perform operations such as reformatting, modifying the size, definition, form, wording, and coding of the content he transmits for verification and use purposes, and waives any right to take action in the event of technical modifications made by the Company to the content he transmits.
Any other use by the Company may only be made with the User's prior explicit consent. Without prejudice to its rights under the Privacy Policy with regard to personal data, the User may contact the Company with any questions relating to the use of its User content by contacting Customer Service in accordance with the provisions of Article 18 of these Terms and Conditions.
The Site may contain links to other websites that are not owned and/or controlled by the Company. These third-party websites may be official government, institutional, private, or commercial websites.
The Company has no control over the content, personal data protection policies or practices of third-party sites and disclaims all responsibility in this regard.
The User acknowledges and accepts that the Company is not responsible for the availability of these external sites and resources and does not endorse the advertising, products or other materials appearing on, or accessible from, these external websites or resources.
The User acknowledges and accepts that the Company cannot be held liable for any loss or damage that he may suffer as a result of the availability of these external sites or resources or as a result of the reliance placed on the completeness, accuracy or existence of any advertising, product or other material on or accessible from these websites or resources.
The Company encourages Users to be vigilant when leaving the Site and to read the terms and conditions and personal data protection principles of other sites they may visit.
The Company authorizes the User to create:
— One or more links pointing to the Site's homepage,
— One or more links pointing to the home page of the different sections of the Site.
However, if the link(s) created by the User appear likely to harm its interests, the Company reserves the right to terminate this authorization at any time and to require the User to immediately remove the offending hyperlink(s). In any event, the existence of a link from a third-party site to the Site does not imply any cooperation between the Company and that third-party site.
As with the links from the Site mentioned above, the User acknowledges and accepts that the Company does not exercise any control over third-party sites and therefore assumes no responsibility for the content, products, services, information, materials, software of third-party sites that link to the Site.
Any User who does not wish to adhere to these Terms and Conditions must refrain from accessing the Site, the Services and the functionalities offered by them.
The User will not be able to use the Site and its features and, consequently, accept these Terms of Service if:
— He has not reached the legal age of majority required to enter into a contract with the Company and does not have the full capacity to accept these General Terms and Conditions of Use,
— He is not acting for strictly personal gain,
— The laws of his country of residence or the country from which he accesses or uses the Services prohibit him from receiving or using the Services or prohibit such receipt or use.
Acceptance of these Terms and Conditions results, as applicable:
— by the User selecting one of the two options offered when starting the CV Generator test ("Create a new CV" or "I already have a CV"), after being informed on this page that starting the test implies acceptance of these Terms of Service and the Privacy Policy; and/or
— by ticking the box provided for this purpose on the Site as part of the registration and Customer Account creation procedure provided for in Article 4 above.
In any event, the use of the Site by the User implies full and complete acceptance of these Terms and Conditions.
The Company reserves the right to modify these Terms and Conditions unilaterally and without notice.
By using the Company's Sites and Services, Users acknowledge and accept, without restriction or reservation, these Terms of Service in both letter and spirit, and agree to refer to them systematically each time they connect. If these Terms of Service are modified, and the User does not agree to the new Terms of Service, they must refrain from continuing to use the Site.
All the provisions of the Terms and Conditions, which are also printable, can be consulted free of charge and at any time on the Site, in the dedicated "Terms and Conditions" section.
Access to the Services via Subscription implies that the User accepts and complies with the General Terms and Conditions of Sale of the Company (hereinafter referred to as the "General Terms and Conditions of Sale"), available in the "GTC" section of the Site.
These General Terms and Conditions of Sale, expressly accepted before any subscription to a Service Subscription, shall apply to any Customer User, cumulatively with these General Terms and Conditions of Use and any Special Terms and Conditions of Use that may also exist in accordance with Article 14 below.
Some of the features offered may require the User to accept and comply with specific conditions, a license to use or a charter of use (hereinafter referred to as the "Specific Conditions of Use and/or Sale") available on the Site pages dedicated to these features.
Unless otherwise stated, these Special Terms of Use and/or Sale shall apply cumulatively with these General Terms and Conditions of Use.
However, in the event of any conflict with these General Terms and Conditions of Use, the Specific Terms of Use and/or Sale shall prevail.
In the event of force majeure, the obligations arising from these General Terms and Conditions are suspended for the entire duration of their execution.
However, if the case of force majeure persists beyond a period of 30 (thirty) consecutive days, these General Terms and Conditions will be automatically terminated, unless otherwise agreed by the Parties.
The following are considered force majeure events under these Terms and Conditions, in addition to those usually recognized by the case law of the competent English courts and tribunals: strikes, lockouts, attacks, severe weather, epidemics, blockages of transport and supply routes, earthquakes, fires, storms, floods, water damage, governmental or legal restrictions, disruptions in telecommunications (Internet and/or mobile telephony) and all other events beyond the control of the Parties, preventing the normal performance of these Terms and Conditions or the normal use of the Site, its Services and its features.
The Company’s failure to enforce any breach or default by the User of any of its contractual or legal obligations shall not be construed as a waiver of its right to enforce such breach or default.
The fact that the Company does not avail itself of a provision of these General Terms and Conditions does not in any way constitute a waiver of the benefit of said provision.
Computerized records kept in the Company’s computer systems under reasonable security conditions will be considered as evidence of communications between the User and the Company.
The archiving of these Terms and Conditions of Use, accepted by the User under the conditions set forth in Article 11 above, is carried out on a reliable and durable medium so as to constitute a faithful and lasting copy. In the event of a conflict between the Company's computerized records and any document in written form or electronic file belonging to the User, it is expressly agreed that the Company's computerized records shall prevail over the User's documents and shall be the sole admissible evidence.
For any questions relating to these Terms and Conditions, the Site and its features or the Services in general, the User is invited to contact the Company via the "Contact" section of the Site, allowing contact with Customer Service by email and post.
The Company also reminds Users that it is their responsibility to ensure they receive emails from the Company.
These Terms and Conditions are governed by English law.
In the event of any dispute that may arise in connection with the execution or interpretation of these Terms and Conditions, and before any possible legal action, the Client User is invited to contact the Company in order to reach an amicable settlement (conventional mediation procedure or any other alternative dispute resolution method).
In the event of a dispute, and failing an amicable agreement between the Client User and the Company, jurisdiction is granted on a non-exclusive basis to the competent courts of Saffron Walden (GB).
Finally, if the Customer User wishes to draw the Company's attention to a particular subject relating to these Terms and Conditions, they can also contact Customer Service in the "Contact" section of the Site.
